Morley Terms and Conditions of Sale

This website is operated by Wolsey Limited, trading as Morley Menswear, a company registered in England with registered number 3246062 and with the registered office of 2 New Star Road, Leicester, LE4 9JD United Kingdom (“we” and “us”). 

These terms and conditions apply to any purchase on this website you make so please take the time to read this. These terms and conditions do not affect your statutory rights.

1. The contract between you and us.

1.1 We must receive payment of the whole of the price for the goods that you order before your order can be dispatched. Once your payment has been received by us we will confirm receipt of your order and payment by sending an email to you at the email address on your order. Acceptance of your order shall only take place when we dispatch the items. Our acceptance of your order brings into existence a legally binding contract between us.

1.2 All items offered for sale by us are offered on an 'invitation to treat' basis only. This means that we are not obliged to sell you an item on the terms stated until we have dispatched the item to you. 

1.3 You can place an order via phone, email or on our website. All of our contracts are concluded in English. All orders will be based upon prices and delivery charges in force at the time you submit your order. If the prices are different from those published you will be notified before we accept your order. 

1.4 When you place an order and make a payment, you will be asked to supply information about yourself. We shall only process your information in accordance with our Privacy Policy.

2. Products advertised online

2.1 We make every effort to ensure that sizes, photographs and descriptions are accurate, but please note that some details such as colour and measurements may vary. Reasonable care has been taken to ensure that reproduction of colours is as accurate as the photographic and printing process will allow. However, slight variations may occur. Garment specifications are correct at the time of posting on the website. 

2.2 All items are subject to availability. We shall inform you as soon as possible if the product(s) you have ordered are not available, and if you have already paid for the product, refund you as soon as reasonably possible.

2.3 We reserve the right to cancel your order at any time if we need to do so and shall in no circumstances be liable to you for more than the sums you paid for the goods.

3. Methods of payment

3.1 We accept Pay Pal, VISA, VISA Electron, Delta, Mastercard, Maestro, Switch, Solo and American Express. 

3.2 While we try to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel as a result of a price change and you have already paid for the goods, you will receive a full refund.

4. Delivery

4.1 We usually deliver items by courier. Our delivery times and prices are here.

4.2 For delivery outside of the UK, you must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our website. The importation or exportation of certain goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

5. Cancellation and Returns

5.1 We hope you are happy with your purchase, however, in addition to your statutory rights, if for any reason you would like to cancel an order please follow the procedure below.

 5.2 If you would like to cancel your order, please let us know within 14 days of receipt of the goods. Notification of cancellation must be made in writing to Morley, 2 New Star Road, Leicester, LE4 9JD or via email to customerservice@morley1795.com or using our Contact Us form.

5.3 Once you have notified us that you are cancelling your order, the sums paid for the goods in question will be credited to your account as soon as possible and in any event within 30 days of receipt of your notice to cancel.  You must take reasonable care of the goods in question whilst they are in your possession, and return them with the original packaging, the original labels and the completed returns form.  You must take reasonable care to ensure that we receive the goods and that they are not damaged in transit. If you do not return the goods delivered to you or do not pay the costs of delivery (if applicable), we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

5.4UK Returns: Returns are free if you live in the UK (England, Wales, Northern Ireland, Scotland, Isle of Man, Isle of Wight and the Highlands). Items should be returned within 14 days of receipt of the goods using the Freepost returns label on the returns form provided with your delivery. 

5.5 Non-UK Returns: If you live outside the UK you must arrange for the return of goods using the assigned courier that delivered the order or a courier of your choice, at your own cost and within 28 days of receipt of the goods. We will not refund the cost of returning the goods. 

5.6 Regrettably, for hygiene reasons, we cannot accept the return of any underwear.

5.7 If for any reason you return one of the items supplied under any promotional offer, where you do not wish to receive an exchange for the returned garment, we reserve the right to withdraw the promotion and charge you the full price for the item(s) retained. 

5.8 We cannot accept responsibility for any returned goods lost or damaged in the post. Once the items are delivered to you, they remain your responsibility. Please ensure you keep proof of postage when returning the goods. 

5.9 The provisions relating to cancellation of orders do not affect your statutory rights.

If your goods are of unsatisfactory quality or are not fit for purpose, please accept our apologies and return them using the Freepost returns label for UK deliveries, and through paid for postage or courier for non-UK deliveries. In relation to non-UK deliveries, if the goods are found to be faulty we will reimburse the postage/courier cost for the return of the goods.  Please keep a receipt as proof of such costs for this process as you may be required to show this to us.  If the items you return to us are, in our reasonable opinion, not deemed to be faulty, you will bear the postage/courier costs associated with returning the goods.

6. General

6.1 We may amend these terms and conditions of sale at any time by posting the amended terms on the website. All amended terms automatically take effect 14 days after they are initially posted. Please ensure that you check the website from time to time to review the then current terms and conditions of sale.

6.2 All rights, including copyright, in this website are owned by or licensed to Morley Menswear. Any use of the website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Morley Menswear.

6.3 We have taken every care in the preparation of the content of this website. To the extent permitted by applicable law, and save as otherwise specified by us, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. 

6.4 These terms and conditions of sale are governed by English Law. Any dispute arising out of or in connection with these terms and conditions of sale shall be subject to the exclusive jurisdiction of the English courts.
